Agreement to Terms

By downloading, browsing, accessing or using this application (“Mobile Application”), and the related PROME services, you agree to be bound by these Terms.

We reserve the right to update these terms at any time. If you disagree with any of these Terms of Use, you must immediately discontinue using our services. Continued use of our services will constitute acceptance of these Terms, as may be amended from time to time.

Description of Service

We are the community for creators who can help eachother by sharing their content and grow rapidly.

Basic Terms

By using our service, you are agreeing to be bound by the following terms and conditions (“Terms of Use”).

  • You must be 18 years or older to use this site, Application, or services
  • If you are younger than 18 years then you have to get permission from your guardian
  • You may not post nude, partially nude, or sexually suggestive photos
  • You must not create or submit unwanted ‘spam’ to any person or any URL
  • You must not post or submit any copyrighted Content which doesn’t belong to you
  • You must not transmit (or attempt to upload or to transmit) any worms or viruses or any code that destruct or damage our service or part of services
  • You may not use the service for any illegal or unauthorized purpose. International users agree to comply with all local laws regarding online conduct and acceptable content
  • You must not use services that violate any International/local laws in your jurisdiction (including but not limited to copyright laws)
  • You must not sale, resale, transfer to other users without any permission.
  • You may not copy, modify, translate, publish, broadcast, transmit, distribute, perform, display, or sell any Content appearing on or through the Services
  • You may not sell or otherwise transfer your profile to others user
  • You must not provide any fake information such as name, phone, email, location, etc.

We use some third-party services to improve our service. So before using our site, application, service please visit their policy first.

User Content

You are responsible for your use of the Services and for any Content you provide, including compliance with applicable laws, rules, and regulations. You should only provide Content that you are comfortable sharing with others.

The Services may enable users to upload, post and transmit photos and videos, text, music, messages, information, comments, or other content or materials (collectively, the “User Content”). Users of the Services may also extract all or any portion of User Content created by another user to produce additional User Content, including collaborative User Content with other users, that combine and intersperse User Content generated by more than one user.

Any User Content will be considered non-confidential and non-proprietary. You must not post any User Content on or through the Services or transmit to us any User Content that you consider to be confidential or proprietary. When you submit any content through the services, you agree and represent that you own that Content, or you have received all necessary permissions, clearances from, or are authorized to transmit it from the Services.

You retain all intellectual property rights in and to any User Content you post, upload or otherwise make available through the Services, including the copyright in and to your photos and videos. We do not claim any ownership, right, title or interest in and to your User Content.

You further grant us a royalty-free license to use include, but are not limited to, your user name, image, photo, video, and any of your User Content; We may use your content for advertising revenue and may display advertisements and promotions purpose. The manner, mode and extent of such advertising and promotions are subject to change without specific notice to you.

Limitation of Liability (the ‘Disclaimer’)

Our service is provided “as is”, and we can’t guarantee is will be safe and secure or will work perfectly all the time. TO THE EXTENT PERMITTED BY LAW, WE ALSO DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

We also don’t control what people and others do or say, and we aren’t responsible for their (or our) actions or conduct (whether online of offline) or content (including unlawful or objectionable content). We also aren’t responsible for services and features offered by other people or companies, even if you access them through our service.

Indemnity

You agree to defend, indemnify, and hold harmless PROME, its parents, subsidiaries, and affiliates, service providers and consultants, and each of their respective officers, directors, employees, agents and advisors from any and all claims, liabilities, costs, and expenses, including, but not limited to, attorneys’ fees and expenses, arising out of a breach by you or any user of your account of these Terms or arising out of a breach of your obligations, representation and warranties under these Terms.

Intellectual Property Rights

Unless otherwise indicated, the Application is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Application (excluding User Contents) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the United States, foreign jurisdictions, and international conventions. The Content and the Marks are provided on the Application “AS IS” for your information and personal use only. Except as expressly provided in these Terms of Use, no part of the Application and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

Provided that you are eligible to use the Application, you are granted a limited license to access and use the Application and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. We reserve all rights not expressly granted to you in and to the Site, Application, Content and the Marks.
